Protective Placement

Protective placement is when a court orders a person under a guardianship to live in a particular type of facility or to receive particular services or care. The court will order that the individual is placed in the least restrictive environment possible. Sometimes this can even be the individual’s home.

Protective placement recognizes the person’s constitutional right to liberty, but also the necessity to protect the individual from his or her inability to meaningfully understand the world around them.
