Guardianship Process

A guardianship is a court proceeding used in Wisconsin to appoint a legal guardian. This process is used in situations where an individual has been deemed incompetent. Guardians are appointed to exercise some or all of an individual’s rights. The guardianship may be of the person, property, or both.

The need for a guardian may arise in many different circumstances. Mentally ill individuals may require a guardian once they reach 18 years of age. An assigned guardian may handle their affairs if they have been determined to be incapacitated.

Elderly individuals suffering from Alzheimer’s or other similar diseases may become incapacitated and require a guardian. Additionally, a minor may also need a guardian in special circumstances.
